For thirty years the nitrogen ceiling on manure spreading was a fixed number that nobody expected to move. On 9 February 2026 the European Commission moved part of it, and that changes how a poultry unit should be thinking about its litter.

What actually changed on 9 February 2026
The Nitrates Directive 91/676/EEC has always capped the application of livestock manure in nitrate vulnerable zones at 170 kg of nitrogen per hectare per year. Commission Directive (EU) 2026/288 adds a point to Annex III allowing Member States to authorise, above that amount and as a separate additional limit of 80 kg N per hectare per year, the use of certain processed fertilising materials derived from livestock manure. The category is known as RENURE, for recovered nitrogen from manure.
Three points decide whether this is relevant to a given poultry business.
- It concerns processed materials, not raw litter. The qualifying routes named are ammonia stripping or scrubbing producing ammonium salts, reverse osmosis producing mineral concentrates, and struvite precipitation. A trailer of broiler litter remains under the 170 kg regime.
- The criteria are chemical and strict. A mineral nitrogen to total nitrogen ratio of at least 90 %, or a ratio of organically bound carbon to total nitrogen of no more than 3, plus contaminant limits of 300 mg copper and 800 mg zinc per kg of dry matter, and pathogen limits with Salmonella absent in 25 g and E. coli or enterococci at or below 1 000 CFU/g.
- It is an option for Member States, not an automatic right. Transposition runs to 2 March 2028, so the applicable rule on your holding today remains the national one. Check with your competent authority before building an application plan around it.
A fertiliser with a variable label
The reason manure planning goes wrong is rarely the regulation. It is that operators use book values for a product whose composition changes from shed to shed. UK reference figures for broiler litter sit around 28 kg of nitrogen, 17 kg of phosphate and 20 kg of potash per tonne, and a 2024 study in Sustainability comparing current poultry systems against those references found litter from broiler breeder layer systems lower in nitrogen, near 21 kg per tonne, and considerably higher in phosphate, near 25 kg per tonne.
Moisture alone moves the arithmetic. Alabama Cooperative Extension illustrates it simply: a ton of litter containing 60 pounds of P₂O₅ dry carries 54 pounds at 10 % moisture and 48 pounds at 20 %. Add the number of flocks between cleanouts, the bedding material, the storage duration and the pH, and the case for testing each batch rather than quoting a table becomes an economic one. The nitrogen you cannot document is nitrogen you cannot claim against your fertiliser bill.
Four routes out of the shed, and what each one demands

Ammonia is the loss you pay for twice
Nitrogen leaving as ammonia costs a poultry unit in two places at once. Inside the house it degrades air quality for the birds and for the staff. Outside it removes fertiliser value from the litter before it ever reaches a field. The chemistry is straightforward: litter pH is the main driver, and above pH 8 a larger share of ammonium nitrogen converts to ammonia gas and volatilises.
Acidifying amendments applied to litter, alum, ferrous sulfate or phosphoric acid among them, are documented as substantially reducing ammonia volatilisation. Before considering any of them, the ordinary controls come first: drinker management that keeps litter dry, ventilation matched to moisture rather than to temperature alone, and cleanout intervals decided on litter condition rather than on the calendar. Where the money actually is
The honest ranking, for most units, puts avoided cost above new revenue. Litter that is analysed, kept dry and spread against a plan replaces purchased fertiliser at a known value, and it does so this season with no capital outlay. Selling compost off farm comes next, and it works where a horticultural or arable outlet exists within a sensible haulage radius, because manure economics are destroyed by transport distance.
Energy projects sit last for a reason that has nothing to do with their merit. A digester is an industrial asset with its own staffing, maintenance and feedstock logistics, and poultry litter on its own is a difficult substrate because of its nitrogen load. Where it works, it usually works as a shared or regional installation rather than a single-farm one. Anyone quoting a payback period without naming a feedstock mix, a heat outlet and a national support scheme is quoting a hope.
Questions we hear on manure plans
Can poultry litter be spread at any time of year? No. Closed periods, distances from watercourses, slope and weather restrictions are set nationally under the Nitrates Directive and vary considerably between Member States and even between regions. The national action programme, not a general article, is the reference document.
Is phosphate or nitrogen the binding constraint? Often phosphate, and this surprises people. Poultry manure carries a high phosphate load relative to nitrogen, so on soils already high in phosphorus the agronomic ceiling arrives before the nitrogen ceiling does. Balance the plan on the nutrient that runs out first.
Does composting destroy pathogens? A properly managed process with sustained high temperatures throughout the mass substantially reduces pathogen load, which is why turning and temperature records matter. A cold, unturned heap in a corner of the yard does not qualify, and it is also where most of the ammonia goes.
What about manure from a flock under health restriction? That is a regulated situation, not a management choice. Movement and treatment of manure from a holding under restriction follow instructions from the competent veterinary authority, and those instructions override any valorisation plan.
The same nitrogen question, seen from the certification side
Producers working to organic specifications face the same nutrient ceilings with a narrower set of inputs, which makes manure planning a structural decision rather than a seasonal one.
